Judge Nap says it's 'inconceivable' the immigrant who caused fatal hit-and-run was just set free

Again and again, authorities across the United States are opting to protect illegal immigrants from Immigration and Customs Enforcement agents doing their job to keep Americans safe.

A dangerous action Fox News' Judge Andrew Napolitano said was "inconceivable."

Ivan Zamarripa-Castaneda was charged in a hit-and-run accident last week that left the driver of a tractor-trailer that caught on fire dead as the illegal immigrant fled the scene, according to Fox News.

Zamarripa-Castaneda, 26, bonded out of a Colorado jail and avoided detention by ICE agents when local officials waited an hour to notify the agency, Fox News reported.

ICE Denver Field Office Director Jeffrey D. Lynch said Zamarripa-Castaneda was an "immigration fugitive," and Napolitano said it "profoundly wrong" for a judge to give him bail because he fled the scene.

"It was profoundly wrong to give bail at any amount to a person who's a danger to the society," he explained. "They really have to find him now."

 Napolitano said the release was not due to Denver's sanctuary city policy, but because of a "breakdown in communication."

"This is a sheriff who did want to put this guy in federal custody, because the sheriff disagreed with the bail - he had no choice but to honor it," he said. "He didn't want this guy on the streets. Now he's loose on the streets, probably to drive a motor vehicle again."

The outrageous incident draws attention to President Trump calling on Congress to stop funding sanctuary cities, "so we can save American lives."

Napolitano said "the Supreme Court has said Congress can give grants to any state or local government that it wants and that it can attach strings as it wants," adding that Congress can make cooperating with ICE one such string.
